Divorce is governed mainly by the Albanian Family Code.

A reform on 27 June 2018 made important changes: the grounds for divorce were simplified, introducing an accelerated procedure in cases of irremediable breakdown of relationship, and recognizing divorce by mutual consent.

Filing the suit.

One spouse (or both, in mutual consent) files a suit for divorce in court.

Divorce upon request of one spouse (non‑consensual)

Either spouse can request dissolution when, because of such things as continuous quarrels, maltreatment, serious insults, adultery, incurable mental illness, long penal sentence, or other causes constituting repeated violation of marital obligations, joint life becomes impossible and the marriage has lost its purpose for one or both spouses.

Agreement or dispute

If spouses agree (on divorce itself, child custody, property division, support etc.), the process is simpler.

If there is disagreement (custody, alimony, property etc.), it will last longer.

The law requires the court to attempt reconciliation first: a reconciliation hearing is scheduled to see if spouses can settle or continue the marriage.

Parental responsibilities & child welfare.

The best interests of children are central. Custody, visitation, and support will be determined by court based on what’s best for the child.

Time frame

In simple cases (mutual consent, agreement on all issues), the process can be quicker.

In cases with disputes (custody, support, complex finances), it takes longer. Usually it takes 4‑6 months or more, and longer when children are involved.

Costs / Fees

When filing the divorce petition, there is a court fee and notification stamps around 5000 ALL in many cases.

Additional costs include hiring a lawyer, paying for expert reports if needed (e.g. psychological expert for child welfare in contested custody disputes.
